Copyright Infringement Policy

1. Introduction
Sellables Online Marketplace Nigeria Limited (“Sellables,” “we,” “us,” or “our”) respects the intellectual property rights of others and expects users of the Platform to do the same. This Policy outlines the procedure for reporting alleged copyright or trademark infringement occurring on our website, mobile applications, and related services (“Platform”).
2. Copyright Infringement Notice
If you are a copyright owner or authorized agent and believe that material on the Platform infringes your copyright, you may submit a written notice to support@sellables.com.ng. A valid notice must include the following:
- A physical or electronic signature of the copyright owner or authorized agent;
- Identification of the copyrighted work claimed to have been infringed;
- Identification of the allegedly infringing material, including the URL or location on the Platform;
- Your contact details (name, email, telephone number);
- A statement of good faith that the use of the material is not authorized by the copyright owner, its agent, or the law; and
- A statement, under penalty of perjury, that the information provided is accurate and that you are authorized to act on behalf of the copyright owner.
Note: Submitting false or misleading notices may result in liability under applicable law.
3. Our Response
Upon receipt of a valid notice, Sellables may:
- Remove or disable access to the infringing material;
- Notify the user who posted the material;
- Request corrective action or clarification; or
- Terminate or suspend accounts of repeat infringers.
We reserve the right to take further steps available under the Nigeria Copyright Act, 2022 and other applicable laws.
4. Trademark Infringement Notice
If you believe your trademark is being infringed on the Platform, send a notice to support@sellables.com.ng containing:
- The signature of the trademark owner or authorized representative;
- Identification of the infringing material (including URL or location on the Platform);
- Trademark registration details (number, jurisdiction, owner, goods/services covered);
- Your contact details (name, address, email, telephone number);
- A good faith statement that the disputed use is not authorized by the trademark owner, agent, or the law; and
- A statement, under penalty of perjury, that the information provided is accurate and you are authorized to act on behalf of the trademark owner.
5. Legal Framework
The Nigeria Copyright Act, 2022 prohibits unauthorized reproduction, distribution, public performance, or digital communication of copyrighted works. Rights holders may seek the following remedies:
- Injunctions to prevent continued infringement;
- Damages or statutory damages between ₦10,000 and ₦1,000,000 per infringement;
- Seizure and forfeiture of infringing items; and
- Criminal penalties, including fines and imprisonment.
Jurisdiction lies with the Federal High Court of Nigeria. The Nigerian Copyright Commission (NCC) is empowered to enforce compliance through investigation, seizure, and destruction of infringing items.
6. Reservation of Rights
Action taken under this Policy does not constitute a waiver of Sellables’ rights to pursue additional legal or equitable remedies. Sellables does not provide legal representation to complainants or alleged infringers.

NOTWITHSTANDING THE TERMINATION OR SUSPENSION OF ANY USER’S ACCESS TO THE PLATFORM, SELLABLES RESERVES ALL RIGHTS TO PURSUE ANY AND ALL LEGAL OR EQUITABLE REMEDIES AGAINST COPYRIGHT INFRINGERS AND OTHER VIOLATORS OF INTELLECTUAL PROPERTY RIGHTS. NOTHING IN THIS POLICY SHALL BE INTERPRETED AS AN OBLIGATION TO INDEMNIFY, DEFEND, OR PROVIDE LEGAL REPRESENTATION TO ANY ALLEGED INFRINGER, EXCEPT WHERE EXPRESSLY REQUIRED BY LAW OR SPECIFICALLY STATED HEREIN.
